No Stay on BHEL Work at N Chennai Thermal Plant

The Madras High Court on Thursday refused to grant an interim stay on further proceedings in a tender awarded to BHEL by TANGEDCO for commissioning the 2X660 mega watt Ennore Special Economic Zone Supercritical Thermal Power Project at Ash Dyke of North Chennai Thermal Power Station. The court observed that site in question has been handed over to BHEL and it has issued a bank guarantee of `763 crore. The petitioner, Central Southern China Electric Power Design Institute (CSEPDI) - Trishe consortium, contended that awarding the contract to BHEL was illegal and against the Tamil Nadu Transparency in Tenders Act. The petitioner also sought direction to take the CSEPDI’s bid into consideration and the comparative merits of the petitioner and BHEL. Earlier, the Madras High Court had directed TANGEDCO to duly consider the petitioner’s representation while finalising the tender strictly as per the tender specifications and the Tamil Nadu Transparency in Tenders Acts and Rules. On September 27, TANGEDCO passed an order awarding the tender to BHEL after dismissing the Chinese consortium’s representation. Aggrieved by the order, the petitioner moved the HC. The petitioner claimed that TANGEDCO’s order awarding the contract to BHEL was against the very undertaking given by it before the High Court that the petitioner’s representations would be duly considered while finalising the tender.
